Please review the terms below carefully, as they outline our shared responsibilities, payment structure, and service expectations to ensure a smooth and successful partnership.

CANVUS Design Studio – Terms of Service

Welcome to CANVUS Design Studio (“CANVUS,” “we,” “our,” or “us”). These Terms of Service (“Terms” or “Agreement”) govern your use of our services, website, and client portal. By submitting payment, signing an agreement, or using our services, you (“Client,” “you,” or “customer”) agree to be bound by the terms outlined below.


1. Scope of Services

CANVUS Design Studio provides digital marketing, advertising, and creative services for real estate professionals, including but not limited to:

  • Social media marketing and ad creation
  • Funnel design and automation setup
  • Content strategy and video production
  • Lead generation and email nurture systems

Each client’s exact scope of work is defined within the selected package (Done-For-You, Done-With-You, or Starter Commitment) and confirmed during onboarding.


2. Payment Terms

  • Service Packages: Pricing for each package is displayed during checkout or on the CANVUS Design Studio website.
  • Custom Payment Plans: Clients approved for payment plans agree to the payment schedule outlined at purchase (e.g., $500 to start, followed by monthly installments).
  • Non-Refundable Policy: All payments are non-refundable once onboarding has begun, as significant resources, strategy, and personnel are immediately allocated to your project.
  • Ad Spend Disclaimer: Advertising budgets (Meta, Google, etc.) are not included in your package cost and must be funded separately by the client.
  • Late or Missed Payments: Missed or late payments may cause service delays or suspension until payment is received in full.

3. Ad Spend Policy

Your package covers strategy, creative, and management services — not ad spend.

  • Ad spend is paid directly to the advertising platform (Meta, Google, etc.).
  • Clients are responsible for maintaining an active ad budget to ensure campaign performance.
  • Delays or underperformance caused by paused ad spend are not the responsibility of CANVUS.

4. Onboarding and Client Responsibilities

Clients agree to:

  • Provide accurate business information, assets, and credentials within three (3) business days of onboarding.
  • Maintain consistent communication and attend scheduled meetings or calls.
  • Grant necessary access to ad accounts, CRMs, and other required tools.

Delays caused by missing information, incomplete access, or lack of responsiveness may extend timelines or pause work.


5. Project Timelines

Timelines vary depending on responsiveness, ad approvals, and technical setup. CANVUS aims to launch campaigns promptly once all materials are received, but specific launch dates cannot be guaranteed.


6. Revisions and Adjustments

Each creative deliverable includes one (1) round of revisions unless otherwise stated. Additional revisions or requests beyond scope may incur extra fees.


7. 90-Day Lead Guarantee

We stand behind our work. Every CANVUS system is backed by our 90-Day Lead Guarantee — if you don’t generate qualified leads within 90 days of your campaign launch, our team will continue working for free until you do.

This guarantee applies only if:

  • Onboarding is completed within 7 days of purchase.
  • Client maintains consistent ad spend as recommended.
  • Client follows CANVUS’ prescribed strategy and process.

Failure to meet these conditions voids the guarantee. This guarantee does not promise specific sales outcomes.


8. Termination and Cancellation

  • Either party may terminate this Agreement with written notice.
  • Completed work remains billable and non-refundable.
  • Clients on payment plans must fulfill their payment obligations for completed work.
  • Ad accounts and creative assets remain with the client upon full payment.
  • Proprietary frameworks, templates, and automations remain the property of CANVUS.

9. Performance Disclaimer

CANVUS does not guarantee specific revenue or sales results. Success depends on factors beyond our control, including market conditions, ad spend, and client responsiveness. CANVUS will employ proven strategies and best practices to achieve optimal results.


10. Ownership and Portfolio Rights

Upon full payment, final creative assets become the property of the client. CANVUS retains ownership of proprietary tools and systems used during production.

CANVUS reserves the right to showcase completed work in its portfolio, social media, or promotional materials unless requested otherwise in writing.


11. Confidentiality

Both parties agree to maintain the confidentiality of all non-public business information, client data, and marketing strategies shared during the course of this agreement.


12. Limitation of Liability

CANVUS Design Studio and its representatives are not liable for indirect, incidental, or consequential damages. The total liability shall not exceed the total amount paid by the client for services rendered.


13. Chargebacks & Payment Disputes

Clients agree not to file chargebacks for rendered services. Any billing disputes must be raised within seven (7) days for resolution. Unauthorized chargebacks may result in suspension of services.


14. Scheduling, Access & Delays

Project timelines depend on timely access to assets and approvals. If delays exceed seven (7) days, CANVUS may pause delivery until access is granted, without penalty.


15. Independent Contractor

CANVUS operates as an independent contractor. Nothing in this agreement creates an employment, partnership, or joint venture relationship.


16. Force Majeure

CANVUS is not responsible for delays or failures due to causes beyond its control, including platform outages, ad approval delays, labor disputes, or acts of God.


17. E-Sign & Electronic Consent

By checking the agreement box and submitting payment, Client consents to transact electronically and agrees this constitutes a binding electronic signature.


18. Notices

All official notices should be sent to support@canvusdesignstudio.com. Notices to the Client will be sent to the email used during checkout unless updated in writing.


19. Entire Agreement; Updates

These Terms, along with any signed agreement or package selection, form the entire agreement between CANVUS and the Client. CANVUS may update these Terms at any time by posting them at www.canvusdesignstudio.com/terms. Continued use after posting constitutes acceptance of the updated Terms.


20. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.
